Dog Bite Statute
All dog owners in West Virginia are responsible for damages when their dog or other pet injures or bites another individual The person must also be on the owners property when the injury occurs. Provoking a dog to attack is the only exception to the rule. The owner can use lack of knowledge if he does not know that the dog is vicious to defend their case and limit the actual expense of the damages.
Rabid Dog Stature
Owners in West Virginia will be liable to any damages of up to $1,000 if an individual is bitten by a pet that is known by the owner to have contracted Rabies or another type of viral infection.
